Rishi Srinivas is a law graduate, and completed his B.Com LLB (Honors) at School of Law, Sastra University. Apart from this, he has done an internship stint at the NCLT, Mumbai Bench. He is an Associate at AMA, assisting in research and legal support in the field of corporate laws especially Insolvency & Bankruptcy Code 2016 and Real Estate Regulatory Authority.

Biography

Further he has been involved in an interesting case where liquidation of the Corporate Debtor by way of “private sale” had been allowed and where an “exemption from appointing registered valuers was granted” to save costs as a one off case. He has also been part of the team which obtained an order in favour of a consortium of 40 Financial Creditors against RP’s decision of rejecting claims on certain grounds in a long legal battle with the RP and other COC members.  He has also been providing extensive assistance in advising Resolution Professionals in myriad legal conundrums ranging from related party issues, intense a COC disputes, various complexities in cases involving homebuyers. He has also been involved in cases wherein there has been a requirement for creative interpretation of Company law. He was also part various IBC related issued representing the interest of class of creditors in various circumstances and advisory related to the same.

CASES HANDLED

  • Represented and advised a liquidator and helped in obtaining an order of liquidation by way of private sale - the first of its kind order in the Hon’ble NCLT Chennai.
  • Represented and advised the Resolution professional and obtained an order of reversal of interest deducted during CIRP period and obtaining possession of assets of CD that were held by Financial Creditors claiming to be Secured Financial creditors who otherwise were unsecured.
  • Represented the erstwhile management of a Corporate Debtor in arguing the personal guarantor issue during Moratorium.
  • Represented and obtained an order where an “exemption from appointing registered valuers was granted” to save costs as a one off case.
  • Represented and obtained an order in favour of a consortium of 40 Financial Creditors against RP’s decision of rejecting claims on certain grounds.
  • Represented the Resolution Professional on the allegations made by one financial Creditor seeking to treat the other financial creditors as related parties.
  • Represented multiple financial creditors to protect their interests against the unequal treatment being given by the Resolution Professional amongst classes of Creditors.
  • Representing the interests of a Resolution Professional in filing and defending various Applications on different aspects of the IBC in a CIRP of a real estate entity
