Dhanisha is a Law Graduate, and completed her BA.LLB (Hons) in School of Law, Alliance University, Bangalore. She is an Associate at AMA, assisting in research and legal support in the field of Corporate Laws. She has been part of extensive research for the role of corporate guarantor in Insolvency Regulation Process and also involved in legal issues of parallel filing of Claims.

Biography

She is involved in a number of cases involving Insolvency and Bankruptcy Code, 2016 pertaining to Commercial Arbitration and Corporate Commercial Disputes. She has done research and legal assistance in the areas of non-cooperation to CIRP, Claim forms for multiple creditors and matters related to forensic Audit Report. She is part of the team handling matter in High Court, DRT and RERA.

She works on matters relating to corporate advisory to foreign clients. She has represented the firm in “COVID-19 and the Acceleration of Digital Payments and Financial Services in Asia-Pacific – Opportunities and Challenges”; a webinar on fintech as part of the firm’s APG practice.

Dhanisha has assisted in advisory opinions on a plethora of legal complex issues relating to various corporate law issues and did significant work on “force majeure” during the COVID pandemic.

CASES HANDLED

  • Dhanisha is currently assisting on a matter involving advising a financial creditor in DRT and SARFAESI matters where a stay was obtained for inspection of property for sale. Also in approaching DRAT for filing of Caveat and follow up of the matter.
  • Worked on matters of exhaustive filing of claims for a group of operational creditors in various cases involving textile industry.
  • Advising a franchisee owner with regard to exit options and minimal financial exposure against a multinational company.
  • Currently involved in IBC matters on behalf of financial creditors against certain reputed builders.
  • Worked on a case involving a leading financial institution with respect to presence in COC on the basis of corporate guarantee and legal issues surrounding the same.
  • Currently working on a RERA matter advising an HNI “allottee” against the builder, associate and parent companies.
  • Assisted in matters involving corporate advisory to international clients and on issues relating to foreign bankruptcy for Indian exporters
  • Worked on due diligence exercises of Indian companies on behalf of foreign clients as part of cross-border takeover transactions.
  • Worked on advisory for an established builder/developer, having more than 30 years’ experience in the said field, on issues pertaining to force majeure and also assisted in the resultant negotiations with the parties which led to amicable solutions.
  • Currently representing a consortium of operational creditors from the textile sector for substantial dues owed to them in an arbitration and the related legal proceedings in the Hon’ble Madras High Court.
